Lawyer & Notary Process When Buying a Home
September 25, 2026 · 6 min read
Two professionals play key roles when you buy property in Albania: your lawyer and the notary. Understanding what each does helps you buy with confidence. Here is how it works.
The Notary
The notary is a neutral public official who formalises the sale. They confirm the identities of the buyer and seller, verify the contract, oversee the signing and ensure the transaction is legally recorded. The notary is essential, but they act for the transaction, not specifically for you.
Your Independent Lawyer
Your own lawyer works for you alone. They carry out due diligence on the title, check for debts and permits, review or draft the contract to protect your interests, and guide you through every step. Having an independent lawyer is the single best way to protect your purchase.
Why You Need Both
The notary makes the sale official, but only your lawyer looks out specifically for your interests. Relying on the notary or the seller's representative alone leaves you less protected. The two roles work together for a safe purchase.
How the Signing Works
Once due diligence is complete and terms are agreed, the parties meet before the notary to sign the final contract. Payment is arranged as agreed, and the notary records the transfer. Your lawyer ensures everything is correct before you sign.
Buying Remotely
If you cannot attend in person, your lawyer can act through a power of attorney, handling the signing and registration on your behalf.
Tips
- Always appoint your own independent lawyer.
- Do not rely solely on the notary or seller's agent.
- Complete all checks before the signing.
- Use a power of attorney if buying from abroad.
